TERMS AND CONDITIONS OF CARRIAGE

In these terms and conditions “Heart of Kapiti” refers to Heart of Kapiti Limited and/or “On Track Events” and/or “The organisers” (as applicable). Heart of Kapiti Ltd sells all tickets on these terms and conditions and subject to any other terms, conditions or rules applicable to that event.

1. Purchasing tickets

1.1 Tickets you purchase are for personal use. Except as we may agree, you and your party must not re-sell or transfer (or seek to re-sell or transfer) the tickets in breach of the applicable terms. A breach of this condition will entitle Heart of Kapiti to cancel the tickets without prior notification, refund, compensation or liability.

1.2 In addition to the ticket price your order may require payment of a booking fee per ticket, a transaction fee per order and/or other supplementary fees which may apply to the event. Those fees are not refundable and are charged by Eventbrite, our ticketing agent.

1.3 Orders are placed using a credit card payment method through a secure payment portal. We do not store or have direct access to your credit card details.

1.4 All event prices are in the currency indicated on the event ticketing page.

1.5 When a booking is accepted passengers are bound by the terms and conditions of carriage.

1.6 Our shows or events may be photographed, filmed or recorded. Buying a ticket affirms your consent to photography, the filming, and sound recording of yourself as a member of the audience and use of these images on Heart of Kapiti’s social media accounts, email communications and website. If you have any objection, should this happen when you attend a show or event, please contact a member of On Track Events Management.

2. Delivery of tickets and merchandise

2.1 Tickets will be despatched to you electronically via email.

2.2 Always check your tickets carefully upon receipt and advise us promptly of any errors. Mistakes when ordering cannot always be corrected and any corrections are discretionary.

2.3 Pre-purchased merchandise can be collected at the event on the day with proof of purchase.

3. Cancellation Rights

3.1 Tickets cannot be transferred to another person, exchanged, or refunded once purchased.

3.2 In the event that a passenger wishes to change their ticket to an alternate time or date this will only be possible if availability is confirmed by On Track Events. All ticket change request must be emailed to team@ontrackevents.co.nz and if approved will attract an administration fee of $5 per ticket.

4. Refunds

4.1 In the event of cancellation, or late arrival by intending passengers, no refunds will be made.

4.2 No refunds will be given in the event of breakdown or delay after joining the train.

4.3 All sales are final and no refunds given.

5. Attending an event

5.1 All children under the age of 14 must be accompanied by an adult or care-giver, who are reminded of their obligations to adequately supervise and control those in their care.

5.2 All bookings require validation 20-30 minutes prior to the scheduled departure time. Please have photograph ID available should it be requested.

5.3 All passengers must be in possession of a valid ticket. Tickets are valid for the event of issue only.

5.4 The organisers reserve the right to substitute the form and type of motive power or rolling stock if operational needs require it or it is deemed necessary.

5.5 The organisers accept no responsibility for variations to any arrival or departure times. However, every attempt will be made to keep passengers fully informed of any alterations to the schedule.

5.6 Smoking is prohibited on any rail vehicle or in any building, at any time.

5.7 No person shall deposit or discard any litter except in the receptacles provided for the purpose.

5.8 Vintage carriages have steps and narrow doorways. Prams/pushchairs are unable to be used on the train. Any foldable prams/pushchairs can be collapsed and stored in the guards van for the duration of the journey.

5.9 Disabled passengers: Due to the age and design of the carriages it is not possible to board whist seated in a wheelchair.  However we will be pleased to convey passengers of limited mobility whenever possible provided they can step onto the train from the platform, climb up to 3 steps and move to their reserved seats with the help of an able bodied carer.  Our crew would assist guiding the passenger up the step onto the train and arrange for the storage of the wheelchair in the guards van.  The wheelchair must be able to be folded up and cannot be used on the train.   Sorry we are unable to convey mobility scooters.

5.10 Admission to an event is at all times subject to these Conditions of Carriage. If you breach terms, conditions or rules then Heart of Kapiti may refuse admission or require you or other ticket holders to leave the event.

5.11 On Track Events reserves the right to refuse carriage to any person.

5.12 Amongst other things you will need to comply with health and safety rules and any security. No person shall attempt or do any act which may risk his/her own safety, the safety of any other person, or the safe operation of the Railway. Any request or direction by a representative of the On Track Events Staff must be followed. Heart of Kapiti will have rights to refuse admission or eject you if you are involved with abusive, threatening, drunken or other anti-social behaviour, or carry alcohol, offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings.

5.13 Heart of Kapiti Ltd, 707 Operations, VLine, Steam Incorporated, Mainline Steam, Glenbrook Railway, KiwiRail, bus companies and venue owners accept no responsibility for loss or damage to passengers and their belongings.

5.14 On Track Events assumes no responsibility whatsoever to any person for loss, damage, or injury, to property, chattels, apparel or persons, however caused, including consequential claims and expenses.

5.16 Before you finalise your booking, please read all the information that applies to the event and/or ticket. If you or any member of your party has particular requirements please raise these when booking and we will endeavour to address your query. There can be no guarantee that requirements can be met if notified at the event.

5.17 Specific seats or carriage may be allocated to you at the time of booking, but Heart of Kapiti reserves the right to change these seats if needed to others of equal value.

6. Cancellation, change or postponement of an event

6.1 Decisions to change or cancel events are the responsibility of Heart of Kapiti. If an event is rescheduled, changed or moved, Heart of Kapiti will contact you to give you the option of either retaining or exchanging your tickets for the new date/location, or alternatively claiming a refund. If an event is cancelled by Heart of Kapiti you will be offered a refund. Please note that the Booking Fee and any Transaction Fees are not refundable in these circumstances. Heart of Kapiti cannot be held responsible for refunds or for any resulting costs you may incur for travel, accommodation, any other related goods or service or other compensation.

7. Force Majeure

7.1 Should any event be cancelled, postponed or otherwise adversely impacted as a result of a force majeure event, there shall be no refunds for payments already received by On Track Events, but On Track Events will use all reasonable efforts to work with Clients to produce the Event at a later date if necessary, subject to venue availability, and a substitute venue may be used by On Track Events on the rescheduled date(s). Additional fees may be incurred and payable to On Track Events and/or Event Vendors as a result of a rescheduled event.

7.2 Except where otherwise expressly stated in these booking conditions, neither we nor any Third Party Supplier can accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of force majeure. In these booking conditions, ‘force majeure’ means any event which we / the supplier of the service(s) in question / the Third Party Supplier could not, even with all due care, foresee or avoid. Such events may include, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics, fire and all similar events outside the control of the party concerned.
